  1. Terms and Conditions
    1. General

    This is the latest version of the Instalionaire Terms and Conditions since January 1, 2018. If you do not agree with any of our business Terms, please do not accept these Terms.

    These General Terms and Conditions (further as “GTC”) govern the rights and obligations of the parties arising out of a purchase contract concluded between the Customer and the seller. The subject of the purchase contract is the purchase and sale of the online services and packages Instalionaire Starter, Business and Manager (further as “the Instalionaire services”) of Themesis s.r.o. company on the website http://instalionaire.com.

    The seller is registered under file number Sro, Insert number: 40910 / V in the Commercial Register of the District Court of Košice.

    Customer is any person who, through Seller’s sales web pages, has met the conditions specified in the following points of these GTC.

     

      1. Specification of services offered

    The Instalionaire service will only be used for the promotional purposes of the Customer’s Instagram Account.

    The Customer commits to provide full access to the service provider to the Instagram account (login name + password). Otherwise, it will not be possible to deliver the service.

    Furthermore, the Service Customer undertakes to follow the instructions of the Instalionaire Provider during the contractual period. Instalionaire uses the Instagram Account of the Customer to target specific Instagram net targets. This is a very legitimate version of the marketing method that increases the growth of the number of followers to the Customer’s account. The provider is in no way bound to a specific number of new followers, comments, and “likes” in the Customer’s account. The number of new followers depends on the quality and interestingness of the selected Instagram segment by the Customer. The Instalionaire service in the Instagram target segment responds to the posts through the “hash-tags” of the segment, the provider can not guarantee responses to the content with the appropriate material (Example: “#fitness #nutrition” hash-tags with nudity elements) and eliminates responses to inappropriate content such as light porn, violence, gambling, and so on. The service provider is entitled, in particular, due to unexpected situations, to change the terms and conditions – but will immediately inform the Customer of the change. If the Customer does not agree with the changes, he/she must notify or withdraw from the contract within five days. Otherwise, conditions are considered to be accepted.

      1. Order Instalionaire Service and conclusion of the purchase contract

    The validity of the electronic order is the fulfillment of all the prescribed data and the requisites required to complete the order. The order is a draft of the purchase contract.

    No formal confirmation of the order by the seller is required to complete the purchase contract; the contract arises from the delivery of the Instalionaire Service or the Instalionaire Services Package.

    Customer accepts the Business Terms of Service for delivering the Instalionaire Service or the Instalionaire Service Package of the Seller by accepting the order. Customer and Seller’s relationships are governed by these terms of business, which are binding on both parties unless the parties have agreed otherwise.

      1. Payment conditions

    The Customer agrees that by paying the Instalionaire service, he/she understands and accepts all the terms of the services provided. In the case of fraudulent action by the ordering party, the service provider reserves the right to discontinue the service without the right to refund the amount paid in any amount.

    The Customer pays the ordered service via Paypal, GoPay, or by bank transfer to the IBAN bank account: SK1283300000002101176047. When filling in a payment order, the ordering party is obliged to enter a variable symbol that corresponds to the order number.

    The Customer undertakes to pay the purchase price stated in the Seller’s internet shop at the Instalionaire service at the time of subscribing to Instalionaire. Customer receives the Instalionaire service at a cost valid at the time of ordering. Themesis s.r.o. is not a VAT payer. The seller reserves the right to print errors. The purchase price will be deemed to have been paid after the entire purchase price has been credited for a separate part of the delivery to the seller’s account.

    An invoice issued by a purchase contract between the seller and the Customer is also a tax document and is sent to the Customer electronically only after the provider has received the funds. At the Customer’s request, the invoice may also be sent by post, but additional charges of € 3 may be required.

    The Customer can not take over the service until it has been fully paid unless otherwise agreed.

      1. Recurring payment

    When purchasing product packages, recurring payments are created.

    6.1. – Card payments via payment systems of Paypal or Gopay

    Recurring payment means the withdrawal of the agreed amount from the Customer’s card to the seller at predetermined intervals (usually every month).

    GoPay or Paypal process payment card data according to the international security standard PCI-DSS Level 1 (this is the highest level of data security in the financial sector).

      1. a) When the recurring payment is set up
        Recurring payments are based solely on the purchase of Instalionaire recurring services(packages).
      2. b) The maximum amount of recurring payment
        The maximum amount of the recurring payment will be the amount the Customer pays for the first paid month. The amount can be changed just only when the customer asks for it or changes the subscription package.
      3. c) Fixation of recurring payment
        The payment the Customer pays in the first settlement month is fixed and will not be increased or decreased for the entire duration of the service.
      4. d) Date and frequency of recurring payment withdrawal
        The date on which the recurring payment is set for the exact day depends on the date when the Customer was registered and the product purchased for the first time. Repeat payout frequency is set to monthly intervals. The Customer will, therefore, be charged on the day he bought it in the particular month. We reserve the right to change the date of regular payment in favor of the customer. The nature of our business sometimes requires us to provide free days of service if needed, therefore we can move the day of payment. The date of the recurring payment is therefore variable
      5. e) Cancellation of recurring payments
        Customer will be able to cancel the recurring payments at any time without any additional fees, fines and with no explanation required. The opt-out option can be found on the GoPay payment receipt and, also, there will be a link in each e-mail to the client area where you can subscription in Subscriptions. Once canceled, the package will be valid until the end of the agreed period, and can then be re-subscribed at any time by creating a new order.
      6. f) Unless payment will be not paid for a variety of reasons, the seller will try to reclaim the payment repeatedly from customer’s credit card.
      7. g) Preferred communication channel

    The preferred method of communication is email, namely info@instalionaire.com. You can also reach us at the phone number you can find at https://Instalionaire.online. Through the email above, to the Customer’s email contact will be sent to him/her all information about the recurring payments, the purchased product, and everything else related to it.

    6.2. SEPA payments and bank transfers   

    For bank transfers and SEPA payments, a “proforma invoice” is sent to the Customer’s email address each month to serve as a service renewal alert. The Customer has 14 days to decide whether or not to continue with the service. The subscription service must be terminated by email at info@instalionaire.com, by telephone or by canceling the service in the Customer’s area. If he does not do so, the order is considered as accepted, and the Customer is required to pay the last “proforma invoice.” An invoice is sent to the customer immediately after payment and order completion.

      1. a) When the recurring payment sets up
        Recurring payments are set up solely on the purchase of Instalionaire packages.
      2. b) The maximum amount of recurring payment
        The maximum amount of the recurring payment will be the amount the Customer pays for the first paid month.
      3. c) Fixation of recurring payment
        The payment the Customer pays in the first settlement month is fixed and will not be increased or decreased for the entire duration of the service.
      4. d) Date and frequency of recurring payment renewal
        The date of the renewal of the recurring payment is not set for the exact day, depends on the date when the Customer registered and purchased the product for the first time. The frequency of renewal is set to monthly intervals. Therefore, the Customer will receive a “proforma invoice” by email each time on the day he/she purchased, in the relevant month. The date of the recurring payment is therefore variable.
      5. e) Cancelation of recurring payments
        Customer will be able to cancel the recurring payment at any time without any additional fees, fines and with no explanation. The opt-out option is to be found in the “Subscriptions” tab in the Client area. Once canceled, the package will be valid until the end of the agreed period, and can then be re-subscribed at any time by creating a new order.

        The preferred method of communication is email, namely info@instalionaire.com. You can also reach us at the phone number you can find at https://Instalionaire.online. Through the email above, to the Customer’s email contact shared by him, it will be sent to him/her all information about the recurring payments, the purchased product, and everything else related to it.

    The delivery time for Instalionaire on https://Instalionaire.online is 72 hours from receipt of the payment unless otherwise specified on the selling page.
    Upon payment by bank transfer in advance, the delivery time starts to run on the day the payment is credited to the seller’s account. The delivery period may be extended proportionately to circumstances where the delay is due to conditions unrelated to the seller.

    With an order, the customer also receives e-mail access to the Instalionaire Client zone where he can manage his orders, invoices, and contact support. He is also able through this to cancel or renew his service at any time.

      1. Complaints and refunds

    The Customer has the right to request to discontinue the Instalionaire service if the service was not provided according to terms. Furthermore, the Customer is required to notify the seller about the request by sending an e-mail to info@instalionaire.com. The Instalionaire Provider reserves the right to register the application for 48h and the subsequent assessment (compliance, rejection). If the application is approved, the Instalionaire service will be deactivated on the next calendar day from the day the Customer informed the seller by email. In the case of approval, the Customer will be refunded an amount corresponding to the number of days from the time the service was shut down until the end of the service initially agreed and the hourly rate of € 10.00 / hour will be deducted for analyzing and matching the Instagram profile of Customer with the Instalionaire service tool. If the service will be canceled in the first month, the 20€ setup fee will be charged.

      1. Contract withdrawal

    The Customer is legally entitled to withdraw from the contract within 14 days of the conclusion of the contract. As withdrawal from the contract is considered any sign of dissatisfaction of Customer with Instalionaire service or service package Instalionaire that was delivered to the seller by e-mail or in writing

    By law, the Customer has the right to withdraw from the contract according to the following form:

      1. Author rights of the seller

    The Customer undertakes not to distribute the texts, photos used on the Instalionaire Provider’s site without the written consent of the Instalionaire representative.

    The Instalionaire service and its packages sold on this site are the exclusive intellectual property of the seller under Act No. 185/2015 Coll. on Copyright Act. Customer is authorized to use the provided Instalionaire service and solely for its purposes. He is not allowed to disseminate or otherwise distribute the Instalionaire service in any way to the third parties.

      1. Usage and warranty

    The Customer commits to using the Instalionaire site only in a way that respects the Instagram Site Service Terms. Instalionaire Provider is in no way responsible for blocking the account or deleting a photo on Instagram on the Customer’s account. The Instalionaire Provider is not liable for any damages to the account or subject matter of the Customer’s business. Instalionaire does not provide any warranties of any kind for the services provided to the Customer. Since Instalionaire is using an Internet connection to provide a service, the availability of websites is not always guaranteed.

      1. GTC Modifications and Update

    These conditions may change at any time. The notice of change will be deemed valid on the day of publication on the Instalionaire Provider’s site. Instalionaire does not make any further notification of changes to the Instalionaire service provider or software website.

      1. Privacy of Personal Data Policy

    The Provider undertakes that all obtained personal data of the Customer will be used only for the fulfillment of the order. Also, the Instalionaire Provider at this moment undertakes not to provide the Customer’s data to any third party not listed in the GTC or the Terms of Use of the Personal Data. Personal data obtained during the order will only be used for order processing, support, billing, and any related product offerings.

    These data are stored in a strict anti-abuse database.

    For billing we share data with Superfaktúra service (superfaktura.sk, s.r.o, Pri Suchom Mlyne 6, 811 04 Bratislava) and with the Integromat service (Integromat s.r.o, Novakovych 1954 / 20a, 180 00 Prague 8, Czech Republic, Europe, ID: 29152861) for payments pairing.

    Upon request, we will inform you in writing of whether and which personal data we have recorded about you. If incorrect information has been recorded despite our efforts to ensure correct data and up-to-date information, we will correct the information upon request. If you have any questions regarding the processing of your personal information, you can direct them to us and contact us.

      1. Acquisition and processing of personal data

    When you visit our website, our web servers will, by default, record the IP address assigned to you by the ISPs, the site you visit us from, the sites you visit with us, and the date and length of the visit.

    Personal data will only be recorded when you provide us with your own will, for example, through registration via a web form or filling in an order. The transfer of personal data to state facilities and offices is only within the framework of binding legislation. Our discretion binds our co-workers, agencies and account managers.

    By registering on our site and filling in the data on the web form, you entitle us with your consent under Act no. 122/2013 Coll. and you allow us to send you business announcements from which you can, at any time, by law, unsubscribe and therefore your consent will be withdrawn.

    By completing a possible sales form, the customer agrees to include his or her data in the Provider’s database as an administrator and to process them for marketing purposes and to receive commercial notices via electronic means under Act no. 122/2013 Coll., for the period until the withdrawal of consent. At the same time, the client agrees to have sent by the Provider information about the upcoming events and the offer of their business partners.

    Final provisions

    These business terms apply as stated on the seller’s website on the day of the electronic order submission unless there is a written agreement between the parties.

     

    General Terms and Conditions are valid since September 1, 2017.
